By accessing or using the Services, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree, please discontinue use of the Services immediately.

2. Information We Collect

2.1 Information you provide directly

  • Contact information (name, email address, mailing address for physical orders)
  • Account credentials and preferences
  • Billing information — processed by Stripe; we do not store full card numbers
  • A profile photo, either uploaded by you or supplied by Google when you sign in with it
  • Content you create on the platform: community posts and comments, marketplace listings, and inputs you give our AI tools (a script, a business description, an uploaded photo used to build an avatar, and similar)
  • Communications you send us — support requests, chatbot conversations, feedback

4. How We Share Your Information

We do not sell your personal information. We share it only with:

4.1 Service providers — vendors who process data on our behalf, each solely to do the job we use them for:

  • Stripe — payment processing and billing
  • Supabase — authentication, database, and file storage
  • Vercel — application hosting
  • Brevo — transactional and account email (receipts, credit notices, and similar)
  • Anthropic (Claude), ElevenLabs, HeyGen, and Replicate — power the AI text, voice, image, and video-avatar generation inside our tools; the inputs you give a tool are sent to the relevant provider to produce your output
  • Printful — production and shipping of any physical merchandise you order

4.2 Business partners — with your consent or a legitimate interest, and never for a partner's own independent marketing without your explicit consent.

4.3 Legal compliance and safety — when required by law, subpoena, or court order, or to protect the rights, property, or safety of the Company, our members, or the public.

4.4 Business transfers — in a merger, acquisition, or sale of assets, your information may transfer to the acquiring entity; we'll notify you before it becomes subject to a materially different policy.

4.5 With your consent — for any other purpose you explicitly agree to at the time.

5. Data Retention

  • Account and transaction records: at least 7 years, for tax and accounting compliance
  • Support and chatbot conversation records: 3 years after your last interaction
  • Analytics and usage data: identifiable data for 24 months, aggregated data indefinitely
  • Payment information: only as required by Stripe and applicable financial regulation

6. Your Rights and Choices

6.1 All members

6.2 California residents (CCPA/CPRA)

You have the right to know what we've collected about you, request deletion, request correction, and non-discrimination for exercising these rights. We do not sell or share personal information. Email support@aivxlabs.com with the subject line “CCPA Request” — we respond within 45 days.

6.3 EEA, UK, and Swiss residents (GDPR)

You have rights of access, rectification, erasure, restriction, portability, and objection, and may withdraw consent at any time. Contact us at the address above, or lodge a complaint with your local supervisory authority.

8. Children's Privacy

The Services are not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

We use encryption in transit, access controls, and other reasonable measures to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Third-Party Links

Lesson videos and other content may embed or link to third-party platforms (for example YouTube, Vimeo, Loom, or Wistia). We are not responsible for their privacy practices.

We may update this Policy from time to time. Material changes will be posted here with a new effective date, and where appropriate, emailed to you.

2. Terms of Service

Please read these terms carefully. By accessing or using the Services, you agree to be bound by them. If you do not agree, do not use the Services.

1. Agreement to Terms

These Terms of Service (“Terms”) are a binding agreement between you and Podavinci LLC, a North Carolina limited liability company operating under the AIVX Labs brand, governing your access to and use of aivxlabs.com and all associated software, content, and services (the “Services”).

By accessing the Services you represent that you are at least 18, have the legal capacity to enter a binding contract, and agree to these Terms on your own behalf or that of the entity you represent.

2. Services Description

Podavinci LLC provides, under the AIVX Labs brand: structured AI training courses from beginner through operator level; a suite of AI-powered tools for content, advertising, video, voice, and local-marketing production, including AI-avatar training-video generation; a credit-based system for using those tools; a members' community with posts and discussion; a peer-to-peer services marketplace; and digital templates, prompts, and workflows available for purchase.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, without liability to you.

3. Account Registration and Security

  • Provide accurate, current registration information and keep it updated
  • Keep your credentials confidential and never share them
  • Accept responsibility for activity under your account
  • Notify us immediately at support@aivxlabs.com of suspected unauthorized access

We may terminate accounts or refuse service at our discretion.

4. Purchases, Payments, and Subscriptions

4.1 Pricing — All prices are in USD and may change without notice; changes don't affect completed purchases.

4.2 Payment — Processed by Stripe. We do not store complete card numbers.

4.3 Taxes — You're responsible for applicable taxes on your purchase.

4.4 Subscriptions and credits — Membership plans renew automatically each month until you cancel from your billing settings; cancellation takes effect at the end of the current billing period, with access continuing until then. One-time credit purchases and top-ups are not subscriptions and are billed once. Credits, once granted or purchased, do not expire — including after you cancel — and have no cash value. If a tool run fails to produce a result, the credits for that run are returned to your balance automatically.

4.5 Disputed charges — Before filing a chargeback, contact support@aivxlabs.com so we can try to resolve it. An unwarranted chargeback on a valid purchase may result in account termination and pursuit of the disputed amount plus fees.

5. Licenses and Intellectual Property

5.1 Our intellectual property — All course content, software, tools, and AIVX Labs branding are owned by or licensed to Podavinci LLC and protected by intellectual property law.

5.2 Limited license — Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your own personal or business purposes. This excludes reproducing or reselling our content or the Services themselves except as permitted under an active Reseller-tier account or a written agreement with us, and excludes scraping or automated extraction of content or data from the Services.

5.3 Content you generate — Subject to your compliance with these Terms and the Acceptable Use Policy, you own the outputs you create using our AI tools from your own inputs, and may use them commercially. Generated outputs are still subject to the usage policies of the underlying AI providers (Anthropic, ElevenLabs, HeyGen, Replicate) and to the restrictions in Section 6 below — most importantly, you may not use these tools to generate an avatar, voice, or likeness of a real person without that person's consent.

5.4 Content you submit — You keep ownership of content you post (community posts, marketplace listings). You grant us a worldwide, royalty-free license to display and distribute it in connection with operating the Services, and represent that you have the right to post it.

6. Prohibited Conduct

  • Violating any applicable law
  • Infringing another's intellectual property, privacy, or other rights
  • Generating or distributing an AI avatar, cloned voice, or likeness of a real person without their consent
  • Sending unsolicited commercial communications or spam through the Services
  • Uploading malware or attempting unauthorized access to any part of the Services
  • Circumventing credit metering or usage limits on the AI tools
  • Defaming, harassing, or defrauding others through the Services
  • Misrepresenting your identity or affiliation
  • Reverse-engineering or decompiling the Services

7. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any result obtained from them will be accurate or meet your expectations.

8. Limitation of Liability

To the fullest extent permitted by law, Podavinci LLC, its officers, members, employees, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data. Our total liability for any claim relating to these Terms or the Services will not exceed the greater of the amount you paid us in the 12 months before the claim, or $100.

9. Indemnification

You agree to defend and indemnify Podavinci LLC against claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your breach of these Terms, your violation of law, or content you submit.

10. Governing Law and Dispute Resolution

10.1 These Terms are governed by the laws of the State of North Carolina.

10.2 Any dispute (excluding claims for injunctive relief) will be resolved by binding individual arbitration under the American Arbitration Association's Commercial Arbitration Rules, in Charlotte, North Carolina.

10.3 Claims may be brought only in an individual capacity, not as a class or representative action.

10.4 Either party may seek emergency injunctive relief in court pending arbitration.

10.5 Non-arbitrable matters proceed exclusively in North Carolina courts.

11. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Provisions that should survive termination by their nature will.

12. Modifications to Terms

We may modify these Terms; material changes are posted with a new effective date and, where appropriate, emailed to you.

13. Miscellaneous

  • These Terms, our Privacy Policy, and our Refund Policy are the entire agreement between us on this subject
  • If any provision is unenforceable, the rest remains in effect
  • Our failure to enforce a provision isn't a waiver of it
  • You may not assign your rights under these Terms without our consent; we may assign ours freely
  • We're not liable for delays from causes beyond our reasonable control
  • Nothing here creates an agency, partnership, or employment relationship
  • You consent to receive communications from us electronically

3. Refund & Cancellation Policy

1. Overview

We want you to be satisfied with AIVX Labs. Because most of what we sell is delivered digitally and immediately, our ability to offer refunds is necessarily limited. Please read this policy before purchasing.

2. Digital Products and One-Time Purchases

2.1 Credits and top-ups

Purchased credits are added to your balance immediately and usable across every tool and course. Because delivery is immediate, credit purchases are final and non-refundable once any portion of the purchased credits has been spent. If you contact us within 7 days of purchase and haven't used any of the newly purchased credits, we'll refund the purchase and remove the unused credits.

2.2 Templates, prompts, and digital products

These unlock instantly on purchase. Sales are final once the content has been unlocked. If you haven't unlocked it, contact us within 14 days for a refund.

2.3 AI-generated deliverables

Video, voice, image, or text deliverables produced through our tools (including AI-avatar training videos) incur real third-party production cost at the moment they're generated. Once a deliverable has finished generating, it is final and non-refundable.

2.4 Print-on-demand merchandise

Merchandise is produced only after you order it, made specifically for you. Sales are final except where an item arrives damaged, defective, or materially different from its listing — contact us within 14 days of delivery with photos for a replacement or refund.

3. Subscriptions

3.1 Cancellation — Cancel anytime from your billing settings. Cancellation takes effect at the end of the current billing period; you keep access until then. We don't prorate partial periods.

3.2 Refunds — Fees already paid for the current billing period are non-refundable upon cancellation.

4. Services Marketplace Listings

The services marketplace connects members offering services with members who want them. Podavinci LLC is not a party to that transaction and does not guarantee delivery, quality, or refunds for a service purchased from another member — that's between the buyer and the listing member. The recurring fee a member pays to keep their own listing active is a separate charge, covered by Section 3 above.

5. Chargebacks and Payment Disputes

Contact support@aivxlabs.com and allow us 10 business days to resolve a dispute before filing a chargeback. An unwarranted chargeback on a valid purchase may result in account termination, collections referral, and legal action to recover the amount plus fees.

6. How to Request a Refund

Email support@aivxlabs.com with your name, the email on your account, your order or transaction ID, and what you're requesting a refund for. We respond within 5 business days; approved refunds post to your original payment method within 5-10 business days.

7. Policy Modifications

We may modify this policy at any time. The policy in effect at the time of your purchase governs that transaction.

4. Affiliate & FTC Disclosure

1. FTC Compliance Statement

This disclosure follows the FTC's guidelines on endorsements and testimonials (16 C.F.R. Part 255) and its guidance on online advertising disclosures.

2. Our Referral Program

AIVX Labs runs a referral program between members, not a cash-commission affiliate network. When a member shares their personal referral link and someone joins using it, both the new member and the referring member receive a bonus of AI credits added to their account — never a cash payment. This is the entirety of our current affiliate-style arrangement.

If you share your referral link publicly (a post, a video, a review), disclose that you'll receive credits for signups through it.

3. Compensation Disclosure for Testimonials

Some testimonials come from members who received free or discounted access in exchange for honest feedback, or who otherwise have a relationship with us. We disclose that connection near the testimonial when it exists. Where no disclosure appears, the testimonial was given without incentive, to the best of our knowledge.

4. No Guarantee of Results from Testimonials

Testimonials reflect one member's real experience and are illustrative only. Results vary based on effort, market, and many factors outside our control. See our Earnings Disclaimer.

5. Third-Party Services We Use

AIVX Labs is built on services from Stripe, Supabase, Anthropic, ElevenLabs, HeyGen, Replicate, and Printful. These are infrastructure providers we pay to operate the product — not paid endorsements or affiliate placements, and we receive no commission from them for your use of the Services.

6. Sponsored Content

We don't currently run sponsored content. If that changes, anything paid for or produced with a third party will be clearly labeled “Sponsored” or “Paid Partnership.”

AIVX Labs provides education and AI-powered tools. Any reference to income, revenue, or business growth in our marketing, training content, or member testimonials describes possibilities based on individual cases — it is not a promise that you will achieve similar results.

2. Results Vary

Results depend on factors including:

  • The nature and current state of your business
  • Your market, niche, and competition
  • The effort and time you invest in implementation
  • How consistently you use the training and tools
  • Changes to the third-party AI models we depend on — Anthropic's Claude, ElevenLabs, HeyGen, and Replicate-hosted models — which may change capability, availability, or cost at any time, outside our control

Some members see fast results. Others see modest results over time. Some see none.

Our tools rely on third-party AI providers we don't control. They may change their models, pricing, or availability at any time without notice, which may affect the quality or cost of anything you produce with our tools. We disclaim liability for any impact from those changes.

We don't currently use advertising cookies.

Lesson videos may embed players from YouTube, Vimeo, Loom, or Wistia, which may set their own cookies under their own policies when you play them.

3. Counter-Notification

If your content was removed in error, you may submit a counter-notice with your signature, identification of the removed content and its former location, a good-faith statement of mistake, your contact information, and consent to jurisdiction. We'll forward it to the original complainant and may restore the content in 10-14 business days absent a court order.

4. Repeat Infringers

We terminate, in appropriate circumstances, accounts of repeat infringers.

5. Misuse of DMCA Process

Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing can create liability. Don't submit false notices.

8. Acceptable Use Policy

1. Purpose

This Acceptable Use Policy governs your use of AIVX Labs — our courses, AI tools, community, and marketplace — and is incorporated into our Terms of Service.

2. Permitted Use

Legitimate personal or business use: learning, building AI-assisted marketing or business assets, offering real services in the marketplace, and engaging with the community in good faith.

3. Prohibited Uses

3.1 Illegal activity

Any use in connection with an illegal activity, including fraud or deceptive trade practices.

3.2 Harmful or non-consensual AI content

  • Generating an AI avatar, cloned voice, or likeness of any real person without their explicit consent
  • Creating content intended to harass, defame, or deceive a real person or business
  • Using our tools to impersonate another individual or entity
  • Generating deliberately false or misleading information about a person or company

3.3 Unauthorized resale

Reselling access to the Services, course content, or generated deliverables outside of an active Reseller-tier account or a written agreement with us.

3.4 Technical abuse

  • Unauthorized access attempts against any part of the Services
  • Automated scraping or data extraction
  • Introducing malware or harmful code
  • Circumventing credit metering or usage limits

3.5 Community and marketplace standards

  • Abusive, harassing, or discriminatory posts
  • Sharing another person's personal information without consent
  • Posting a marketplace listing for a service you can't or won't actually deliver
  • Spam or unsolicited solicitation
  • Fake reviews or misleading endorsements

4. Monitoring and Enforcement
